Trademark Symbols TM SM ® © – When To Use and How Type Trademarks

When it comes to trademarks there is a variable alphabet soup that you can use if you want to stake your claim to a name, logo, a slogan or something else you’ve created for your business.

You’ve all seen the little ™ next to a business name or logo, there’s also ℠. I’m 100% sure you’re all familiar with that ® so.

What those all mean, when you can use them and what the differences are between them?



So the TM of course stands for „Trademark“ the SM stands for „service mark“.

If you want to trademark a name or a logo or anything else that you can trademark you can put the TM next to it to show people that you are claiming common law trademark ownership over that mark.

If your business is service related such as a marketing agency, you can alternatively put that SM which is „service mark“.

It doesn’t really matter if you’re a service based business and you use the TM it’s the same thing.

Some people if it’s a service business like to use SM instead, either way they’re both going to let people know that you are staking a trademark ownership claim over that mark, and pretty much anybody can use the SM or TM.

You don’t have to have a registered trademark you just have to believe and know for a substantial certainty that you have proper common-law ownership over that mark.

In the circle, on the other hand is reserved only for people who have a registered trademark.

A federally registered trademark that’s the only time you can use that R in a circle if you use.

It when you don’t actually have a registered federal trademark, you could get in trouble with the trademark office. So if your goal is to be able to put that little R in a circle next to your business name or in your business’s logo you’ve got to make sure that you get it registered as a trademark.
